1. Acceptance of Terms

By using HireJosie, you agree to these Terms of Service. If you are using the service on behalf of a business, you represent that you have authority to bind that business to these terms.

2. Service Description

HireJosie provides AI-powered phone answering, appointment booking, and related services for small and medium businesses. The service includes AI call handling, post-call SMS summaries sent to callers, booking confirmation messages, and call summary emails to business owners. Service availability is subject to our 99.9% uptime SLA on paid plans.

3. SMS and Text Messaging Terms

By using HireJosie, you acknowledge and agree that HireJosie will send transactional SMS messages to individuals who call your business phone number. These messages are triggered automatically after a call ends and contain a summary of the call interaction and any follow-up actions. Booking confirmation messages are sent when appointments are scheduled. Messages are sent only to callers who have initiated a phone call to your business — HireJosie does not send unsolicited messages. You are responsible for informing your callers that they may receive a text message summary after their call. Message and data rates may apply to message recipients. Recipients can opt out at any time by replying STOP to any message. You agree not to use the HireJosie SMS functionality to send spam, marketing messages, or any content unrelated to call interactions handled by the service.

4. Consent and Compliance

You represent and warrant that your use of HireJosie complies with all applicable laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and any state or provincial regulations governing automated calls and text messages. Consent to receive SMS messages is implied when a caller initiates a phone call to your HireJosie-powered business number. You agree not to use HireJosie to contact individuals on the National Do Not Call Registry for marketing purposes. HireJosie is a transactional messaging service, not a marketing platform.

5. Acceptable Use

You may not use HireJosie to make unsolicited marketing calls or send unsolicited text messages (spam), misrepresent your identity to callers, violate any applicable telemarketing or messaging laws (TCPA, DNC registry, A2P messaging regulations), use the SMS functionality to send messages unrelated to call interactions, or engage in any illegal activity. Violations may result in immediate account termination.

6. Subscriptions and Billing

HireJosie offers a free tier and paid plans. The free tier is available indefinitely with usage limits. Paid subscriptions are billed monthly. You may cancel at any time and your service continues through the end of the billing period. No refunds are issued for partial months.

7. Call Recordings and Compliance

You are responsible for ensuring that recording calls is permitted under applicable law in your jurisdiction. HireJosie can be configured to announce recording at call start. Consult legal counsel if you are unsure about your obligations.

8. Limitation of Liability

HireJosie's liability is limited to the amount paid by you in the three months preceding any claim. We are not liable for indirect, incidental, or consequential damages including lost profits, missed appointments, or undelivered SMS messages.

9. Termination

Either party may terminate at any time. We may suspend or terminate accounts that violate these terms, including misuse of the SMS messaging functionality. Upon termination, your data is retained for 30 days and then permanently deleted. SMS opt-out records are retained indefinitely.

10. Governing Law

These terms are governed by the laws of the State of Delaware, United States. Disputes shall be resolved by binding arbitration in accordance with JAMS rules.
